Criminal record for filesharing

You have fallen out with a girl/boy friend - big time. He/she wants to get revenge and emails the BPI at antipiracy@bpi.co.uk and FACT at contact@fact-uk.org.uk with information about your collection of downloaded and copied music and DVDs.

Early one morning a solicitor and some heavy looking people turn up at your door with a court order, take away all your CDs, DVDs, your computer, your mobile phone ... It is not just you who ends up with a very large fine and a criminal record, but all your friends houses are raided, too, with the information collected from your PC and mobile.

Is this justified? Has the law gone too far?
